Terms of Service

1. General

Benkyō Mashou (mobile app) (“Service”) is operated by MWD Services LLC (“Benkyō Mashou,” “us,” or “we”), located at 1846 E. Innovation Park Dr., Ste. 100, Oro Valley, AZ 85755, USA. Access and use of the Service are subject to the following Terms of Use (“Terms”). By accessing or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications.

Benkyō Mashou may update these Terms periodically, and the date last revised will be indicated at the bottom. If you do not agree to abide by these Terms, you are not authorized to use or access the Service.

2. Description of Service

The Service allows users to learn Japanese through a variety of features, including AI-based speaking practice, SRS flashcards, and phrasebooks. Benkyō Mashou may, at its sole discretion, update, modify, or discontinue any aspect of the Service temporarily or permanently.

3. In-App Purchases and Subscriptions

All in-app purchases and subscriptions for Benkyō Mashou are handled by third-party platforms, including Apple App Store, Google Play Store, and RevenueCat. By making a purchase or subscribing to the Service, you agree to abide by the payment terms and policies of these platforms.

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. Subscription management, including cancellations, must be handled through your Apple or Google account settings. Benkyō Mashou cannot process subscription cancellations directly.

4. Refund Policy

Benkyō Mashou offers a full refund if the refund is requested within 14 days of the transaction date(purchased date). After 14 days, refunds are not accepted. Refunds must be requested through the Apple App Store or Google Play Store in accordance with their respective refund policies. 5. User Representations and Warranties

You represent and warrant that your use of the Service will comply with these Terms and all applicable laws and regulations. You agree that any content you submit via the Service (e.g., audio recordings during AI-speaking practice) is your own and does not infringe on the rights of any third party. You agree not to: (i) reverse-engineer, decompile, or disassemble any part of the Service; (ii) use the Service for any unlawful or unauthorized purpose; or (iii) interfere with or disrupt the Service, servers, or networks connected to the Service.

6. Indemnification

You agree to indemnify and hold harmless Benkyō Mashou, its officers, employees, and agents from any claims, liabilities, damages, or expenses arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

7. Limitations of Liability

Benkyō Mashou is provided on an “as-is” basis. We disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose. Benkyō Mashou shall not be held liable for any damages, including direct, indirect, incidental, or consequential damages, arising from the use of the Service. The AI-powered features in the Service are designed to provide feedback and improve your learning experience. However, the AI may not always provide accurate or error-free feedback. The Service should not be relied upon as a sole source of learning.

8. Termination & App Deletion

If you wish to discontinue using our services, you can simply delete the app from your device. No additional steps are required as Benkyō Mashou does not require an account.

9. Proprietary Rights

All content available on the Service, including text, graphics, images, and software, is the property of Benkyō Mashou or its licensors. You may not modify, reproduce, or distribute this content without explicit permission.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, USA, without regard to conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Arizona, USA.

11. Changes to Terms

We reserve the right to update these Terms at our discretion. Please review the Terms periodically for updates. Continued use of the Service after such updates indicates your acceptance of the revised Terms.
